DMCA Copyright Policy

1. Respect for Intellectual Property

GemsCoins respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the GemsCoins website (the "Site") that are reported to our designated Copyright Agent.

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that any material on our Site infringes upon your copyrights, you may submit a DMCA Notice of Alleged Infringement.

2. Submitting a DMCA Takedown Notice

To request the removal of infringing content, please provide us with a written notice containing the following information:

  • Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works must be provided.
  • Identification of the Infringing Material: A description of the material that you claim is infringing, including a precise URL or location on our Site where the material can be found, so that we can locate it.
  • Contact Information: Your address, telephone number, and, if available, an email address where we can contact you.
  • Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notice Procedure

If you believe that your content was removed (or to which access was disabled) by mistake or misidentification, you may submit a Counter-Notice. The Counter-Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the URL/location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district, and that you will accept service of process from the person who provided the original DMCA notification.

4. Repeat Infringers

It is the policy of GemsCoins, in appropriate circumstances and at our sole discretion, to disable or terminate the accounts of users who repeatedly infringe copyrights or intellectual property rights of others.

5. Contact Us

Please submit all DMCA Takedown Notices and Counter-Notices through our Contact Us page. We will process and investigate valid notices and will take appropriate actions under the DMCA and other applicable intellectual property laws.

Note: Please allow up to 3-5 business days for an email response. Note that emailing your complaint to other parties such as our Internet Service Provider will not expedite your request and may result in a delayed response due to the complaint not being filed properly.
